Payment and Default
In the event of Buyer’s default on any payment obligation, Seller reserves the right to cancel the order or delay shipment without liability for costs or expenses arising from such cancellation or delay. A late payment charge of one and one-half percent (1.5%) per month (or the maximum legal amount, if lower) may be added to all past-due balances. Buyer is responsible for reasonable attorney's fees, costs, and expenses incurred in connection with the collection of past due balances. A returned check fee of $40.00 will be charged for each returned check.
Warranty
Seller warrants that the prices and other conditions of sale comply with all applicable government orders and regulations. Seller guarantees that the goods have clear title, free from any security interest, lien, or encumbrance. No changes or modifications to these terms of sale are valid unless explicitly stated. Except as provided herein, Seller makes no warranties or representations, express or implied, regarding the merchantability or fitness for any particular use or purpose of the goods sold.
Limitation of Liability
Buyer assumes all risk and liability for the results obtained from the application, use, or processing of the goods sold, whether used alone or in combination with other products. Buyer shall defend, indemnify, and hold Seller harmless against any and all losses, costs, damages, expenses, and claims made by any person for injuries (including death) or damages to property arising from the use or processing of the goods sold.
SELLER SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES UNDER ANY THEORY OF LIABILITY. IN NO EVENT SHALL THE SELLER'S LIABILITY EXCEED THE PRICE OF THE GOODS SOLD UNDER THIS AGREEMENT. SELLER DISCLAIMS ANY LIABILITY FOR DAMAGES CAUSED BY THE BUYER'S HANDLING, TRANSPORTATION, FINISHING, OR ALTERATION OF THE PRODUCT.
Force Majeure
Seller shall not be liable for any delay or failure in performance caused, in whole or in part, by fire, flood, severe weather, catastrophic events, wars, riots, embargoes, strikes, lockouts, governmental appropriation, or allocation, martial law, shortages of transportation, failure of supply of goods or materials, or any other circumstances of commercial impracticability beyond the Seller's control.
Freight and Shipping
All prices are based on will-call pricing and do not include shipping charges. You may request a shipping quote or use your preferred shipper. Orders are shipped within 1-2 business days, with delivery expected within 5-7 business days. For shipments to Alaska, Hawaii, and international destinations, please contact us for shipping rates.
We use common carriers such as FedEx and USPS for small packages. For large orders, we use freight curbside delivery. Most items are not shipped to PO Boxes and we do not accept C.O.D. orders.
Any changes to the delivery address or order must be made 24 hours before shipment.
Drop Ship and Online Sales
The seller does not engage in or support drop shipping. Buyer certifies that any product purchased from Seller will not be sold online on multi-channel sales sites, including but not limited to Amazon, eBay, Sears, or any other online sales platforms.
