Terms of Sale
These Terms of Sale govern your purchases from TOUCH Cabinets Hardware ("touchcabinetshardware.com," "we," "us," or "our"), ensuring a smooth and transparent transaction process. By making a purchase from us, you agree to be bound by these Terms of Sale, along with our Terms of Use and Privacy Policy. This agreement supersedes any prior agreements or representations related to your purchase.
We reserve the right to update or modify these Terms of Sale at any time without prior notice. Your continued purchase from TOUCH Cabinets Hardware following any changes indicates your acceptance of the new terms. Therefore, please review these terms regularly.
1. Pricing and Payment
You will be charged upon placing your order. We accept all major credit cards and other payment methods available on our site. For check payments, a $50 returned check fee applies. Taxes, shipping, duties, and other charges are additional to listed prices. If there is a billing error, notify us in writing within ten business days.
2. Pricing Information
While we strive for accuracy, errors in pricing or product information may occur. TOUCH Cabinets Hardware reserves the right to correct any errors and cancel orders if necessary. Prices and availability are subject to change without notice.
3. Order Acceptance
We reserve the right to refuse or cancel any order for any reason, including errors in product or pricing information or issues identified by our credit and fraud department. We will notify you if your order is canceled or if additional information is required.
4. Backordered Products
If an item is out of stock, we will notify you and provide options such as cancellation, selecting alternate products, or waiting for the item to become available.
5. Drop Ship and Online Sales
Buyer certifies that any product purchased from Seller will not be sold online on multi-channel sales sites, including but not limited to Amazon, eBay, Sears, or any other online sales platforms.
6. Tax-Exempt Purchases
For tax-exempt purchases, verify your status with your state or local taxing authority and provide the necessary documentation.
7. Freight and Shipping
Shipping costs and types vary depending on the product. We aim to ship your items as quickly as possible, but unforeseen circumstances beyond our control may affect delivery times. TOUCH Cabinets Hardware is not responsible for delays caused by events such as natural disasters, labor disputes, or other force majeure events. Any additional shipping or storage costs due to customer-caused delays or incorrect information will be charged to the customer.
All prices are based on will-call pricing and do not include shipping charges. You may request a shipping quote or use your preferred shipper. Orders are shipped within 1-2 business days.
8. Shipping Destinations and Delivery Restrictions
We generally ship to most addresses within the United States, excluding PO boxes. Some products may have delivery restrictions based on location. For international orders, we may ship to freight forwarding service providers within the contiguous United States.
Ensure your shipping information is correct before placing an order. TOUCH Cabinets Hardware reserves the right to cancel orders with false addresses intended to evade state sales tax.
9. Force Majeure
TOUCH Cabinets Hardware shall not be liable for any delay or failure in performance caused, in whole or in part, by fire, flood, severe weather, catastrophic events, wars, riots, embargoes, strikes, lockouts, governmental appropriation, or allocation, martial law, shortages of transportation, failure of supply of goods or materials, or any other circumstances of commercial impracticability beyond the Seller's control.
10. Cancellations
Orders can be canceled or modified within a short time after placement. Once shipped, cancellations are not possible. Any changes to the delivery address or order must be made 24 hours before shipment.
11. Warranty
TOUCH Cabinets Hardware warrants that the prices and other conditions of sale comply with all applicable government orders and regulations. TOUCH Cabinets Hardware guarantees that the goods have clear title and are free from any security interest, lien, or encumbrance. No changes or modifications to these terms of sale are valid unless explicitly stated. Except as provided herein, TOUCH Cabinets Hardware makes no warranties or representations, express or implied, regarding the merchantability or fitness for any particular use or purpose of the goods sold.
12. Limitation of Liability
Buyer assumes all risk and liability for the results obtained from the application, use, or processing of the goods sold, whether used alone or in combination with other products. Buyer shall defend, indemnify, and hold TOUCH Cabinets Hardware harmless against any and all losses, costs, damages, expenses, and claims made by any person for injuries (including death) or damages to property arising from the use or processing of the goods sold.
TOUCH CABINETS HARDWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES UNDER ANY THEORY OF LIABILITY. IN NO EVENT SHALL THE TOUCH CABINETS HARDWARE'S LIABILITY EXCEED THE PRICE OF THE GOODS SOLD UNDER THIS AGREEMENT. TOUCH CABINETS HARDWARE DISCLAIMS ANY LIABILITY FOR DAMAGES CAUSED BY THE BUYER'S HANDLING, TRANSPORTATION, FINISHING, OR ALTERATION OF THE PRODUCT.
